Welcome to KloteBayRam! These Terms of Service ("Terms") govern your use of our website and services. By accessing or using KloteBayRam, you agree to be bound by these Terms. If you do not agree, please do not use our service.

1. Acceptance of Terms

By creating an account or using KloteBayRam, you confirm that:

• You are at least 18 years old
• You have the legal capacity to enter into this agreement
• You will comply with all applicable laws and these Terms
• All information you provide is accurate and up-to-date

2. Description of Service

KloteBayRam provides:

• Product Comparison: Price and availability comparison across multiple e-commerce stores
• AI Recommendations: Personalized outfit suggestions based on your preferences
• Virtual Try-On: AI-generated images showing how products might look on you
• Style Tools: Outfit drafting, saved looks, favorites, and shopping assistance

We are NOT a merchant. KloteBayRam does not sell products, process payments, or handle shipping. We are a comparison and recommendation platform that links to third-party merchants.

3. User Accounts

3.1 Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

3.2 Account Termination

You may delete your account at any time through your Profile settings. We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Use automated tools to scrape our data
• Impersonate others or provide false information

4. Acceptable Use

4.1 Permitted Use

You may use KloteBayRam for personal, non-commercial purposes to:

• Compare product prices and features
• Get outfit recommendations
• Try on products virtually
• Save and organize your shopping preferences

4.2 Prohibited Use

You may NOT:

• Use automated bots, scrapers, or crawlers to extract data
• Reverse engineer, decompile, or disassemble our service
• Resell or redistribute our recommendations or data
• Upload inappropriate, offensive, or copyrighted content
• Impersonate others or create fake accounts
• Interfere with the service's operation or security
• Use the service for any illegal purpose

5. Virtual Try-On & AI Features

5.1 Fair Use Limits

To ensure service quality for all users, we implement usage limits:

• Free Tier: 2 try-on renders per day, 3 personas, 5 outfit drafts
• Future Premium Tier: Higher limits (pricing TBD)

5.2 AI Accuracy Disclaimer

Virtual try-on images are AI-generated approximations, not photorealistic previews. Actual fit, color, and appearance may differ. We recommend:

• Checking merchant size charts before buying
• Reading product reviews and return policies
• Using try-on as one factor in your decision, not the only factor

5.3 Photo Usage

By uploading photos for virtual try-on, you grant us a limited license to:

• Process your photo through AI models to generate try-on images
• Store your photo securely in your account
• Display the photo to you in your profile and try-on results

We will NOT:

• Share your photo with merchants or third parties (except AI service providers bound by confidentiality)
• Use your photo for advertising or promotional purposes without explicit consent
• Train AI models on your photo (our AI providers are contractually prohibited from this)

6. Product Information & Pricing

6.1 Accuracy

We strive to provide accurate product information and prices, but:

• Prices and availability are subject to change without notice
• Merchants may update listings after we fetch them
• The final price is determined by the merchant at checkout

Always verify price and availability on the merchant's website before purchasing.

6.2 No Price Markups

We do NOT mark up merchant prices. If you see a price discrepancy:

• The merchant may have changed their price since we last synced
• Some merchants show different prices based on your location or login status

7. Affiliate Relationships

Transparency: KloteBayRam participates in affiliate programs and networks including Admitad, INRDeals, Cuelinks, Amazon, Flipkart, Myntra, and others. When you click a product link and make a purchase, we may earn a commission at no extra cost to you.

Affiliate commissions do NOT influence our recommendations. Our AI curates outfits based on your preferences, not which merchant pays the highest commission.

8. Purchases & Transactions

You purchase directly from merchants, not from KloteBayRam. We are not a party to your transaction. The merchant's terms, return policy, and customer service apply.

• Payment: Processed by the merchant (Amazon, Flipkart, etc.)
• Shipping: Handled by the merchant
• Returns: Subject to the merchant's return policy
• Customer Support: Contact the merchant for order issues

If you have a problem with a purchase, contact the merchant first. We can help you find their contact information but cannot process refunds or exchanges.

9. Intellectual Property

9.1 Our Content

All content on KloteBayRam (design, code, logo, algorithms, recommendations) is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not:

• Copy, reproduce, or redistribute our content
• Use our brand name or logo without permission
• Create derivative works based on our service

9.2 Your Content

You retain ownership of photos and other content you upload. By uploading content, you grant us a license to use it as described in these Terms and our Privacy Policy.

9.3 Product Images & Data

Product images and descriptions are owned by their respective merchants. We display them under fair use for comparison purposes. If you are a merchant and believe we are displaying your content improperly, contact us.

10. Third-Party Services

Our service integrates with third-party platforms:

• Merchants: Amazon, Flipkart, Myntra, Ajio, Nykaa Fashion, etc.
• AI Providers: OpenAI, Google Gemini (for recommendations and try-on)
• Infrastructure: Supabase, Cloudflare

We are not responsible for third-party services' availability, terms, or privacy practices. Use them at your own risk.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

• The service will be uninterrupted, secure, or error-free
• Product information or prices are accurate or up-to-date
• Virtual try-on images accurately represent how products will look on you
• AI recommendations will meet your expectations
• Merchant links will always work

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

KloteBayRam and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from:

• Your use of the service or inability to use it
• Purchases made through merchant links
• Inaccurate product information or prices
• Data loss or security breaches
• Third-party actions (merchant disputes, payment issues, etc.)

Our total liability for any claim shall not exceed ₹1,000 or the amount you paid us in the past 12 months (whichever is greater).

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless KloteBayRam, its affiliates, and employees from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your misuse of the service
• Content you upload or share

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, India.

14.2 Informal Resolution

Before filing a legal claim, please contact us at ramakrishnacharyjonnalagadda@gmail.com to resolve the issue informally. Most disputes can be resolved this way.

14.3 Arbitration

If informal resolution fails, disputes may be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending an email to registered users (for significant changes)

Continued use of the service after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KloteBayRam regarding use of the service.
